Terms
Last updated 19 September 2026
These terms cover use of buildwithfatfish.com and the work FatFish Digital Ltd (“Build with FatFish”, “we”, “us”) does for you. By applying for an audit, ordering a package, or subscribing to Site Watch, you agree to them.
They are written for a founder with no legal team. If a clause is about something you have not bought, it does not apply to you yet.
Who we are
FatFish Digital Ltd is a company registered in England and Wales. We will publish our company number on this site when it is issued. English law applies. The courts of England and Wales have exclusive jurisdiction.
Using this website
You may use the site to read about our work, download the playbook, apply for an audit, and contact us. Do not misuse the forms, attempt to break the site, or submit other people’s sites without permission.
Content on the site is general information, not a personal security assessment, until we have actually audited your site.
Launch Audit
When you apply you warrant that you own the site, or that you have the owner’s permission to have it audited. If you submit a site you are not allowed to have tested, you are responsible for that. We may refuse or pause an audit if we doubt permission.
The Launch Audit is free. You give us the URL, and we send a written report and a short video walking you through the site. Every issue is in plain language, ranked by what matters. Work after the audit is priced once we have seen the site.
We deliver within two working days of a complete order, unless we agree another date with you. There is no call unless you want one.
If we find nothing worth fixing, you keep the report. You can show it to customers, investors or an auditor.
The audit is professional advice based on what we can see at the time. Sites change. It is not insurance, and it is not a certificate that nothing will ever go wrong.
Packages
Package names, prices and what is included are on the Packages page. Prices exclude VAT. “From” prices are starting points; we confirm the scope and fee before we start.
Work is done by David Lane, David Caswell and Owais Nizam, or by someone we introduce to you in writing first.
Unless a package says otherwise, paid fix work carries a 30-day guarantee: if the thing we said we would fix breaks in the same way within 30 days of us marking it done, we will put it right at no extra labour charge. The guarantee does not cover a change you (or a tool) made afterwards, a third-party outage, or a problem we did not agree to fix.
We will not start paid work until we have agreed what is in and what is out.
Site Watch
Site Watch and Site Watch Plus are monthly subscriptions. You can cancel at any time. Cancellation stops the next renewal; it does not refund the month already started.
If you have bought a package from us, Site Watch is half price for the first three months.
Site Watch tells you when something we check has changed or broken. It is monitoring, not a 24-hour operations team, unless you are on a plan that includes engineering time and we have agreed to use it.
Fees and payment
All prices on the site exclude VAT. We will add VAT where it applies.
One-off work is payable in advance unless we agree otherwise in writing. Subscriptions are billed monthly in advance. If a payment fails we may pause the work or the subscription until it is fixed.
Your materials and ours
You keep everything you already own: your product, your brand, your content, your data. You give us a licence to access what we need to do the work.
We keep our methods, templates, playbooks and tooling. You get a licence to use the report, video and deliverables we produce for your own business. You may not resell them as a product.
Confidentiality
We will treat your audit findings, code, customer information and business plans as confidential, and we expect the same from you about our unpublished methods and pricing discussions. That does not stop either of us sharing information the law requires, or information that is already public.
If something goes wrong
Nothing in these terms limits liability for death or personal injury caused by negligence, or for fraud, or for anything the law does not let us limit.
We are not liable for loss of profit, loss of customers, loss of data, or indirect or consequential loss. For paid work, our total liability is limited to the fees you paid us for that work in the 12 months before the claim. For a free Launch Audit, our liability is limited to £0 beyond that.
Websites, hosts, DNS, email providers and AI tools fail. We will do the work with reasonable care and skill. We do not promise Google rankings, uninterrupted uptime, or that a site can never be attacked.
Ending the work
You can stop a subscription as set out above. For one-off work, either of us can stop if the other materially breaks these terms and does not fix it within 14 days of being asked in writing. If you cancel a package before we finish, we will invoice for work already done and refund the rest, unless the cancellation is because you withdrew access we need.
Changes
We may update these terms. The date at the top will change. New terms apply to new orders and to subscription renewals after we post them. They do not rewrite a package already in progress unless we both agree.
